Property Conditions and Disclosure:
South Carolina has a property condition disclosure law. The form is a
statewide form and is required by all sellers of real estate ( For Sale
By Owners, Multi-List Properties, For Sale by Builders).
The first page has 12 questions regarding the house
systems. There are 3 boxes to check for each question.
1. Yes 2. No 3. No Representation
The second page asks about the Environmental Hazards,
Nuisances, fire damage, variance violations, Restricted Uses of
Property, Flood Hazards, Home Owners Association etc.
The third page allows for written comments regarding
answers.
In over 12 years of full time experience in representing
buyers, I never seen a disclosure statement that approached the
information found in professionally prepared inspection report.
